トピック1. The Federal Circuit’s Recent Precedential Written Description Requirement Decisions（英語での講演）

It has been more than two years since the U.S. Supreme Court decided Amgen v. Sanofi addressing the written description requirement under 35 U.S.C. § 112(a) in biotechnology. The U.S. Federal Circuit has now issued two precedential decisions involving written description in pharmaceutical cases, Duke v. Sandoz and Seagen v. Daiichi Sankyo. This lecture analyzes the Federal Circuit’s decisions and explains how to satisfy the written description requirement in the life sciences.

トピック2. “Skinny” Labels and Induced Infringement Before the U.S. Supreme Court: Hikma Pharmaceuticals USA, Inc. v. Amarin Pharma, Inc（英語での講演）

This term, the U.S. Supreme Court will take up a patent case for the first time in nearly three years. In Hikma Pharmaceuticals USA, Inc. v. Amarin Pharma, Inc., the Court will consider the scope of induced infringement where a generic manufacturer launches a product with a “skinny” label and promotes uses that go beyond the FDA-approved labeling. This presentation will review the legal and regulatory landscape governing “skinny” labels and assess how the Court’s decision could reshape litigation strategy and risk assessment for both branded pharmaceutical companies and generic entrants.

（米国最高裁判所において、いわゆる「スキニーラベル」について誘引侵害の適用可否を争点とする訴訟が取り上げられることになりました。そこで、同争点を巡る現在の法規制の状況と、最高裁判所により今後示される判断が製薬企業・ジェネリック企業の訴訟・リスクマネジメントに与え得る影響について分析します。）

最終拒絶理由が通知された後の手続について、米国特有の制度の一つである継続審査請求（Request for Continued Examination: RCE）を中心に説明します。
