- Topic 2: Induced Infringement After Hikma v. Amarin - Intent, "Active Steps," and the Future of the Hatch–Waxman Bargain(英語での講演)
- On June 4, 2026, a unanimous Supreme Court in Hikma Pharmaceuticals USA Inc. v. Amarin Pharma, Inc. reset the standard for induced patent infringement under 35 U.S.C. § 271(b) to install an intent-based line for liability. We will use the VASCEPA skinny label dispute to discuss where that line now falls and how that line can be crossed or avoided. We will focus on the same prong of the inducement test that the Supreme Court used—“active steps to encourage direct infringement”—and raise broader implications in the shift for pleading—and proving—induced infringement.
