(6) Qualifications forParticipating in the Tendering
Procedures
(A1) A supplier who does not come
under Article 70 of the CabinetOrder concerning Budget, Auditing
and Accounting (Imperial OrdinanceNo. 165 of 1947). Furthermore, a
minor, a person underconservatorship or a person under
assistance who has obtained theconsent necessary for concluding
the contract falls under the caseof special reasons within said
clause.
(A2) A supplier who does not come
under Article 71 of the CabinetOrder concerning the Budget,
Auditing and Accounting.
(A3) A supplier qualified underthe "qualification for
participating in tenders (singlequalification for every ministry
and agency)" who, prior to thedeadline of submission of tender,
received a qualificationexamination and was registered in
the registry of qualified tenderparticipants. A supplier shall meet
all of the qualifications asspecified in items (i) through
(vii) below, in accordance with the
types of
services as set forthrespectively in the specification
sheets. In cases where a singlesupplier is unable to meet all of
the qualifications as specified initems (i) through (vii) below, two
or more suppliers who meet therespective requirements may
participate in the tenderprocedure, on the premises that
such suppliers conclude a groupagreement.
(i) In the case of a supplierwho renders "monitoring services,"
such supplier shall have Grade A, B
or C for the classification of"land survey," "construction
consultant" or "land and buildinginvestigation" as provided for in
the qualification for participating
in tenders by organizations in the
Kitakyushu area related to theMinistry of Finance in the fiscal
years 2015 and 2016, or Grade A, B,
C or D for the classification of"provision of services, etc." as
provided for in the qualificationfor participating in tenders by
organizations related to theMinistry of Finance (single
qualification for every ministryand agency) in the fiscal years
2016, 2017 and 2018, and beeligible to participate in
tendering procedures in the Kyushuand Okinawa area, and, such
supplier shall retain at least five
staff members qualified asbuilding lots and buildings
transaction specialists (Article 18
of the Building Lots and Buildings
Transaction Business Act).
(ii) In the case of a supplierwho renders "underground objects
investigation services," suchsupplier shall have Grade A, B, C
or D for the classification of"general civil works" or Grade A, B
or C for the classification of"scaffolding, civil works, concrete
works" or "constructionconsultant" as provided for in the
qualification for participating intenders by organizations in the
Kitakyushu area related to theMinistry of Finance in the fiscal
years 2015 and 2016
(iii) In the case of a supplierwho renders "mowing and maintenance
services," and "garbage removalservices," such supplier shall have
Grade A, B or C for theclassification of "garden works" or
Grade A, B, C or D for theclassification of "general civil
works" as provided for in thequalification for participating in
tenders by organizations in theKitakyushu area related to the
Ministry of Finance in the fiscalyears 2015 and 2016, or shall have
Grade A, B, C or D for theclassification of "provision of
services, etc." as provided for inthe qualification for participating
in tenders by organizationsrelated to the Ministry of Finance
(single qualification for everyministry and agency) in the fiscal
years 2016, 2017 and 2018, and beeligible to participate in
tendering procedures in the Kyushuand Okinawa area.
(iv) In the case of a supplierwho renders "fence building
services" and "services of closureof openings," such supplier shall
have Grade A, B or C for theclassification of "garden works,"
or Grade A, B, C or D for theclassification of "general civil
works," as provided for in thequalification for participating in
tenders by organizations in theKitakyushu area related to the
Ministry of Finance in the fiscalyears 2015 and 2016.
(v) In the case of a supplierwho renders "services of
preparation and installment ofsignboards," such supplier shall
have Grade A, B or C for theclassification of "garden works,"
or Grade A, B, C or D for theclassification of "general civil
works," as provided for in thequalification for participating in
tenders by organizations in theKitakyushu area related to the
Ministry of Finance in the fiscalyears 2015 and 2016, or shall have
Grade A, B, C or D for theclassification of "provision of
services, etc.," as provided for in
the qualification forparticipating in tenders by
organizations related to theMinistry of Finance (single
qualification for every ministryand agency) in the fiscal years
2016, 2017 and 2018, and beeligible to participate in
tendering procedures in the Kyushuand Okinawa area.
(vi) In the case of a supplierwho renders "tree cutting
services," such supplier shall have
Grade A, B or C for theclassification of "garden works,"
or Grade A, B, C or D for theclassification of "general civil
works," as provided for in thequalification for participating in
tenders by organizations in theKitakyushu area related to the
Ministry of Finance in the fiscalyears 2015 and 2016.
(vii) In the case of a supplierwho renders "sediment removal
services," such supplier shall have
Grade A, B, C or D for theclassification of "general civil
work," or Grade A, B or C for theclassification of "scaffolding,
civil works, concrete works," asprovided for in the qualification
for participating in tenders byorganizations in the Kita-kyushu
area related to the Ministry ofFinance in the fiscal years 2015
and 2016.
(A4) A supplier who has nodelinquent tax liabilities.
(A5) A supplier whose businesssituation or trustworthiness is
deemed not to have significantlydeteriorated, and whose proper
performance of a contract can beguaranteed.
(A6) A supplier whosequalification has not been
suspended by government agencies(including a supplier specifically
designated by the official incharge of disbursement of procuring
entity).
(A7) A supplier who is not judged
to be inappropriate as the otherparty to the contract on account of
having violated any of the clauses
of a contract concluded with anofficial-in-charge from the
relevant local bureaus, branchbureaus, divisions or offices, or
having been awarded as a winningtenderer of the tender implemented
by said official but refused toconclude the contract without any
justifiable reason, or havingcommitted any illegal or unfair act
in relation to business affairs,such as tender procedures, of the
relevant local bureaus, branchbureaus, divisions or offices.
(A8) With regard to a qualifiedtenderer who, in connection with
the construction works, landsurvey, or consultant services,
etc., is eligible as provided forin the qualification for
participating in tenders byorganizations in the Kitakyushu
area related to the Ministry ofFinance in the fiscal years 2015
and 2016, such supplier shall beone who has not filed a petition
for the commencement ofreor-ganization procedures under
the Corporate Reorganization Act(Act No. 154 of 2002), or one who
has not filed a petition forcommencement of rehabilitation
procedures under the CivilRehabilitation Act (Act No. 225 of
1999). With regard to a supplierwho has filed a petition for
commencement of reorganizationprocedures under the Corporate
Reor-ganization Act or a supplierwho has filed a petition for
commencement of rehabilitationprocedures under the Civil
Rehabilitation Act, such suppliershall have obtained a
recertification of qualificationfor participation in the tendering
procedures after the time ofissuance of the order of
commencement of procedures.
(A9) A supplier who has beengiven a briefing on the outline of
"unused state-owned land management
services" at the tender briefingsession, etc.
(B0) Submission of Tender byTendering Group
(i) In cases where, due togeographical locations and other
factors, a single supplier isunable to implement all the
services, a tender may be submitted
by a group of two or more servicesuppliers capable of properly
implementing the unused state-owned
land management services in therelevant service area (hereinafter
the "tendering group"). In suchcase, one of the tendering group
members, acting as therepresentative of the group, shall
submit the proposal and take thetender procedures in such
representative's name. For makingan application for participation in
tender procedures, a tenderinggroup is required to prepare a
written agreement for the creationof a tendering group and submit it.
For implementing the unusedstate-owned land management
services, the representative of the
tendering group shall beresponsible for coordination and
liaison with the government. Inaddition, the tendering group
members shall also coordinate withthe government so that the services
will be implemented in a smoothand efficient manner. A tendering
group member may not, solely orjointly with another tendering
group participating in the sametender, submit the tender.
(ii) ・The representative of thegroup shall satisfy all of the
requirements specified in items(A1) to (A9) above.
・The members of the groupshall satisfy all of the
requirements specified in items(A1) to (A8) above.
